User Agreement (Public Offer)

for the provision of digital services of the TGuard service

1. General Provisions

This Public Offer is an official proposal pursuant to Articles 435 and 437 of the Civil Code of the Russian Federation and regulates the procedure for providing digital services by the TGuard service. Use of the service or the Telegram bot constitutes full acceptance of the terms of the Offer and confirms the User’s compliance with the Telegram Terms of Service and the Telegram Bot API Developer Terms.

2. Definitions

TGuard Service — a digital platform and Telegram bot for analyzing Telegram channels, detecting bots, generating reports, subscriptions, and certificates.
User — a person using the service.
Services — any digital services of TGuard.
Subscription — temporary access to the service functionality for the paid period.
Telegram — a messaging service and the infrastructure through which the bot operates. Telegram is not a party to this agreement.

3. Subject of the Agreement

The Provider supplies digital services, and the User agrees to pay for them. Services are considered delivered at the moment they are performed. Services are not goods, have no material form, and do not require delivery.

4. Acceptance Procedure

Acceptance of the Offer includes:

• starting to use the Telegram bot;
• payment for services or a subscription;
• providing data for analysis;
• receiving a report or certificate.

Acceptance means agreement with the terms of the contract and Telegram policies.

5. Rights and Obligations of the Provider

The Provider undertakes to:

• provide the User with access to TGuard digital services;
• ensure the proper functioning of the service within technical capabilities and within Telegram API limitations;
• comply with personal data protection legislation;
• respond to reports of violations and abuses within the service.

The Provider has the right to:

• temporarily restrict access to the service during updates or technical work;
• refuse service in case of violation of the Offer, fraud attempts, violations of Telegram rules, or the use of the bot for prohibited purposes;
• modify the service functionality without prior notice when required to ensure correct operation under Telegram API constraints.

6. Rights and Obligations of the User

The User undertakes to:

• comply with the laws of the Russian Federation and the Telegram Terms of Service;
• not use the service for actions violating the Telegram Bot API, including spam, manipulations, automated operations, or mass messaging;
• provide accurate data for analysis;
• pay for services in a timely manner.

The User acknowledges that the scope of analysis is limited by the technical capabilities of the Telegram API.

7. Pricing and Payment Procedure

The cost of services is indicated in the Telegram bot or on the tguard.pro website. Payment is made in advance. Subscriptions are provided only for the paid period and are not renewed automatically.

8. Refund Policy

Services are considered provided from the moment of:

• performing the analysis;
• generating the report;
• subscription activation;
• issuing the certificate.

After the service has begun, a refund is not possible. Before the service begins — a full refund is possible.

9. Liability

The Provider is not liable for:

• consequences of decisions made by the User based on reports;
• failures, limitations, or changes in the Telegram API;
• blocking of channels, accounts, or restrictions within Telegram;
• indirect losses, including lost profits or data.

10. Personal Data

Data processing is carried out in accordance with Federal Law 152. The User agrees to the processing of data, including information provided by the Telegram API. The Provider does not collect or request personal data prohibited by Telegram.

11. Usage Restrictions

• violating Telegram rules and the Telegram Bot API;
• bypassing technical restrictions of the service;
• interfering with the bot or the Provider’s servers;
• transmitting prohibited or harmful content.

12. Telegram and Third-Party Role

Telegram is not a party to the contract, does not participate in payments, and is not responsible for the operation of the TGuard service. Telegram’s terms and restrictions may affect the functionality of the service.

13. Force Majeure

The Parties are released from liability for failure to fulfill obligations due to force majeure circumstances.

14. Governing Law

The Agreement is governed by the laws of the Russian Federation.

15. Final Provisions

The Provider may change the terms of the Offer. Continued use of the service constitutes the User’s acceptance of the changes.
